Legal Warranty

In compliance with the provision of the Legistative Decree nr. 206/2005 (Consumer Code), every product sold by Historic are covered by the 24 months legal guarantee for defects in compliance as required by the current legislation.

The consumer-customer that purchased the products sold by Historic can benefit of the warranty only if presented with the invoice or an accompanying document that confirms the purchased made on the web site.

The warranty duration is of 24 months and is only available in cases where the product purchased from the web site presents conformity defects, has been correctly used, ie according to its intended use or is eventually provided with accompanying documentation. The warranty does not apply in cases of defects caused by improper behaviours or use of the product, not therefore already present in the product itself (Legislative Decree 206/05).

The conformity defect is identified only in cases where the product is not compliant to the description reported on the web site or doesn’t possess the qualities promised by the vendor.

The eventual conformity defect that is manifested during the warranty legal validity period (24 months) must be reported within 60 days from the discovery. In this case, the customer has the right to request to the seller, with no extra costs, the repair or replacement of the goods, unless the request solution will not be possible or too expensive. In the event in which, after viewing the product, the seller does not verify the presence of the contested defects, the customer will be charged with the verification and recovery costs and the shipping costs sustained by Historic as well.


Historic Warranry

If the customer is not satisfied with his purchase, or wishes to change size or colour, the product if unused, can be returned within 14 days after receiving it. For the purpose of an eventual return, it is important that the garment is returned completed with the warranty seal intact (red tag). It is necessary that the customer check his purchase before removing the warranty seal to verify the conformity and correspondence of his purchase compare to what is indicated. The vendor will proceed with the identification of the return only in case that the presence of the warranty seal is verified.  For any hidden defects, please refer to the legal warranty paragraph.

Il contratto di vendita tra il Cliente e Historic si intende concluso in Italia e regolato dalla Legge Italiana. Per la soluzione di controversie civili e penali derivanti dalla conclusione del presente contratto di vendita a distanza, se il Cliente è un consumatore, la competenza territoriale è quella del foro di riferimento del suo comune di residenza; in tutti gli altri casi, la competenza territoriale è esclusivamente quella del Foro di BRESCIA.

The sales contract between the Customer and Historic is intended concluded in Italy if regulated by the Italian law. For the resolution of civil and penal disputes deriving from the conclusion of remote retail sale, if the Client is a consumer, the territorial jurisdiction is by the municipality referred forum, in all of the other cases, the territorial jurisdiction is by the competency of the Forum in Brescia.

 

Conditions

Historic avails itself from the faculty to change the conditions contained in the present document without any notification, and will be valid from the publication date posted in the web site www.historic-brand.com.

 

RETURNS CONDITIONS

- The product must be intact and must not be used, worn or damaged

- The products must be returned with their identification tags and must be neatly packaged

- In case of change of size or wrong colour or evident conformity defects, the garment must be returned with the specific red tag. The returned garments for aforementioned reasons and received without the red tag will be immediate resent to the clients charging them of eventual transportation costs sustained.

 

RETURNS

If, for any reason, the customer is not satisfied of his purchase. The product, if unused, can be return to change a size, or the issuing of a reimbursement coupon, within 14 days from the moment the garment has been received. It is important for eventual returns scopes, that the garment is provided with the warranty tag. It is necessary that the customer will check his purchase before removing the warranty tag, to verify that conformity and correspondence compared that what is indicated. The seller will proceed with the identification of the return only in case that presence of the warranty tag is verified. For eventual hidden defect, please read the legal warranty paragraph.

 

RETURNS INTRUCTIONS

To be authorized and return a product, the customers must send a request to info@historic-brand.com, indicating the product code the he wishes to return and the method of compensation desired: size change, issue of a coupon or reimbursement. Once the return request will be received LABELUX will send a written confirmation to the client with return authorization number.

 

 

 

The return must be done by LABELUX srl, or through DHL. The authorization number must be indicated in CMR letter that must be filled as indicated in the e-mail that you will receive from the shipping/returns office along with the return authorization. (The courier will bring the CMR letter at the moment of the shipping pick up).

The customer can choose between three methods of compensation:

Size change

It is possible to change the purchased garment with the same article in a different colour or size, if available, while, it is not possible to change it with another product.

Issuing of a coupon

The coupon can be used one time only, within three months from the return date. It can’t be cumulated with other coupons and it must spent entirely for a purchase of the same value or superior.

Refunds
Eventuali differenze di import imputabili al tasso di cambio non posso essere rimborsate.

The refunds are done after having received, verified and accepted the product return. In case of orders payed by credit card, the refunded amount will be made available to the customer within 14 days and will visible in the next account balance. The time frame can vary slightly based upon the credit card bank network used. An amount equal to the 10% of the product costs will be withheld for the shipping expenses. In case of prepaid orders payed through Paypal or wire transfer, the amount will be credited in the bank account indicated in the order. The refunds will be done with the same currency of origin. Eventual amounts differences will be imputable to the rate exchange and cannot be refunded.
